1. Who operates this site

In these terms, "we", "us" and "our" mean the operator named above; "you" means anyone using this site.

2. What this service is

LocalListed is a searchable index of publicly available information about UK businesses, compiled from open data. We are an information service and nothing more. We do not sell goods or services on behalf of any business, do not take bookings, do not handle payments between you and a business, and are not party to any contract you enter into with a business you find here.

We do not verify, vet, accredit, rate or endorse any business. Please read our Disclaimer, which forms part of these terms and sets out in detail what we do and do not check.

3. Accuracy

Listings are compiled from community-maintained and government open data and are provided "as is". Details may be incomplete, outdated or wrong. We give no warranty that any listing is accurate, current or complete, and you should confirm details directly with a business before relying on them.

4. Acceptable use

You may browse this site, and link to it, freely. You must not:

• extract, copy or re-use a substantial part of the contents of this site's database, systematically or repeatedly, except as the underlying open data licences permit (see section 5);
• use automated tools to scrape, crawl or harvest the site at a rate that degrades it for others, or in breach of our robots.txt;
• harvest telephone numbers or email addresses for unsolicited marketing: doing so is separately unlawful under the Privacy and Electronic Communications Regulations 2003;
• use the site to send anything unlawful, defamatory, harassing or misleading, including through our enquiry forms;
• attempt to gain unauthorised access to any part of the site, its server, or any connected system: an offence under the Computer Misuse Act 1990;
• impersonate a business, or submit a claim or correction for a business you have no authority to act for.

We may withdraw access to anyone who breaches these terms. Nothing in this section limits the rights the open data licences below grant you in the underlying data.

5. Data, licensing and intellectual property

The information here comes from open data sources, each with its own licence:

• Business listings: © OpenStreetMap contributors, available under the Open Database License (ODbL). If you extract and publish a derived database, the ODbL requires you to attribute OpenStreetMap and to release that derived database under the same licence.
• Food hygiene ratings (Food Standards Agency) and company registration data (Companies House) contain public sector information licensed under the Open Government Licence v3.0.
• Administrative areas come from the ONS Postcode Directory via postcodes.io, under the Open Government Licence v3.0. Contains OS data © Crown copyright and database right, and Royal Mail data © Royal Mail copyright and database right.
• Images are freely licensed only, and are credited to their authors on the page where they appear.

The site's own design, layout, editorial guides and software remain our property or that of our licensors. Business names and trade marks belong to their respective owners.

6. If your business is listed

Listings are created from open data, not from any dealing with the business. If you run a business listed here you may, free of charge, ask us to correct any detail or to remove the listing entirely. Contact us and tell us which listing and what is wrong. We act on such requests promptly.

Removing a listing from this site does not remove the underlying record from OpenStreetMap, the Food Standards Agency or Companies House, which we do not control.

7. Notice and takedown

If you believe anything on this site is defamatory, infringes your rights, or is otherwise unlawful, please contact us with:

• your name and an address at which we can contact you;
• the exact URL of the page complained of;
• the words or content complained of, and why you say they are unlawful;
• whether you consent to your name and details being passed to the person who posted the material, if it was not posted by us.

We will respond in accordance with the Defamation Act 2013 and the Defamation (Operators of Websites) Regulations 2013 where those apply, and will remove or correct material that should not be published.

8. Enquiries sent through this site

Enquiries sent through this site come to us and go nowhere else. We do not operate a quote service or a lead-matching service, and we do not pass your details to any business.

If you want to contact a business listed here, use the telephone number or website published on its listing and contact it directly. Any agreement you reach with a business is between you and them: we are not a party to it and are not responsible for the work carried out, the price charged, or whether they reply at all.

9. Advertising and sponsored listings

Some pages display Sponsoredlistings above the main results. These are paid placements, labelled as advertising. We do not verify or endorse a business because it has paid, and paying does not change a business's position in the main results. Ordinary listings are free and are never charged for.

We may also promote our own marketing services on this site. Buying them has no effect on any listing's position or presentation in this directory.

10. Liability

Nothing in these terms limits or excludes our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot lawfully be limited or excluded. If you are a consumer, these terms do not affect your statutory rights.

Subject to that:

• we are not liable for any loss arising from your dealings with a business listed here - any contract for goods or services is between you and that business;
• we are not liable for loss caused by reliance on information that turns out to be inaccurate, incomplete or out of date;
• we do not guarantee that the site will be available, uninterrupted or error-free;
• if you use this site in the course of a business, we are not liable to you for loss of profit, loss of business, loss of goodwill, or any indirect or consequential loss.

11. Privacy

Our Privacy Policy explains what personal data we handle, our lawful basis for doing so, and your rights. It forms part of these terms.

12. Changes

We may change these terms. The version published on this page applies to your use of the site, and the date it was last changed is shown at the top of this page.

13. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer resident in Scotland or Northern Ireland you may also bring proceedings in your own courts, and you keep the benefit of any mandatory protections of the law of the place where you live.
